1. Booking – how and where?
You can book via the internet www.reka.ch, by telephoning the Central Booking Office +41 31 329 66 99, by fax +41 31 329 66 01 or by e-mail email@example.com. The rental agreement between you and Reka will be concluded upon the explicit and unconditional acceptance of your booking. You will then receive the contract documents from Reka. The processing fee must be paid within 10 days and serves as confirmation.
For bookings made less than 10 days (42 days for Reka holidays abroad) before the start of the rental we need your credit card details before we can make the booking and conclude the contract. You will then receive the contract documents. Only credit cards and the Reka card are accepted means of payment for last-minute bookings (see Section 5).
Holidays with flights
If you are booking a package which includes air transport, please give the passengers’ names and dates of birth spelt exactly as they appear in the travel documents (passport, ID card). Otherwise, you may possibly not be allowed to board your flight.
By making the booking, the tenant accepts the valid rental price published by Reka online for the property which is booked. This price is definitively confirmed in the contract documents. Early bookers (i.e. booking without a known rental price) specifically agree that the current rental price may be adjusted (by a maximum of 5%) until the contract documents have been definitively forwarded.
Extra costs, such as electricity and bed linen, are generally included in the rental price. Detailed information will be found in the price tables (Catalogue/www.reka.ch). Other extra costs which are not included in the rental price must always be settled on the spot and are specified in the contract documents. They cannot be paid for with Reka cheques (except in Reka holiday villages in Switzerland). As a rule you must bring your own kitchen and bath towels (exceptions are mentioned).
4. Processing fee
A CHF 50.00 processing fee is charged for the reservation. It must be paid within 10 days.
The General Terms and Conditions of Payment stated in the booking confir-mation and contract documents apply. The rental price must be paid no later than 42 days before the start of the holiday and can be settled in whole or in part with Reka money (Reka cheques or Reka card) (see notes on the contract documents). If bookings (Reka holidays in Switzerland and abroad) are made less than 42 days before the start of the holiday, the entire invoiced sum including the processing fee must be paid when the contract documents are received. For last-minute bookings made less than 10 days (Reka holidays Switzerland) and 42 days (Reka holidays abroad) before the start of the holiday, credit card or debit card details must be indicated in the guarantee or for direct payment. The following cards are accepted for payment: Visa, Mastercard, American Express, Postfinance (for online bookings only), myOne and the Reka card with sufficient funds. If the processing fee or rental price are not paid on time, Reka may, after allowing a period of grace, withdraw from the contract and charge the processing fees and cancellation costs as set out in Section 15. The processing fee of CHF 50.– or CHF 200.– (Tirreno Resort, Giverola Resort) is charged in every case.
Holiday flats/houses are allocated on a first-come first-served basis. Allocation of accommodation abroad is made by our local partners (preferences may be mentioned when the booking is made but do not form part of the contract). Holiday accommodation is generally rented for full weeks, from Saturday to Saturday. For exceptions please consult the brochures and www.reka.ch. Arrival and departure times are stipulated in the contract documents.
7. Number of Persons
The number of persons occupying Reka holiday homes must not exceed the number stated on the contract documents. Late registrations must be notified to Reka no later than two weeks before the start of the holiday with the names of the persons travelling and their dates of birth. In case of overoccupation Reka may cancel the rental agreement. The price of the accommodation remains payable in full.
In principle pets are not allowed in Reka holiday homes. They are permitted in holiday accommodation indicated by the appropriate symbol (at extra cost, see contract documents).
9. Tenant`s liability and complaints
The tenant agrees to treat the Reka holiday home and its contents with care. He/She must respect the house rules. If any defects are noticed when taking possession of the rented accommodation they must be reported immediately to the key holder/host. Otherwise the accommodation shall be deemed to have been handed over in perfect condition. Defects which cannot be repaired to your satisfaction on the spot must be reported within 48 hours to the Reka Central Booking Office in Bern (tel. + 41 31 329 66 99, fax +41 31 329 66 01, firstname.lastname@example.org). Claims for a reduction and damages should be sent in writing within 7 days of leaving the Reka accommodation (to the Swiss Travel Fund (Reka) Cooperative, Reka Holidays, Neuengasse 15, 3001 Bern). If a claim for a reduction or damages has not been reported in writing to Reka within 7 days of leaving the accommodation, your rights lapse and you lose any possible entitlement to make claims against Reka. The tenant is liable for damage caused by him and his guests. All damage must be reported as quickly as possible, but no later than at the time when the accommodation is handed back. The tenant may still be held responsible for defects which come to light after the accommodation has been handed back. The final cleaning costs declared in the rental agreement apply to a normal final cleaning, i.e. the accommodation must be handed back by the tenant in a clean condition at the end of the rental period. In addition the crockery must be washed, the dishwasher emptied and refuse disposed of. If the accommodation is unusually dirty, the tenant agrees to pay a higher cleaning charge.
10. Use of Reka swimming Pools
a) Young persons under the age of 16 must be accompanied by an adult when they use the swimming pool. Non-swimmers are not allowed to use the pool on their own. Non-swimmers must be supervised at all times in the swimming pool
. Responsibility for permanent supervision rests with the tenant or with the persons retained by him for this purpose. Reka does not appoint a swimming supervisor.
b) The tenant specifically acknowledges and calls the attention of his members of family and other joint occupants of his rented accommodation to the fact that there is no lifeguard at the pool to take emergency rescue measures or administer first aid. Guests therefore use the pool at their own risk.
c) The tenant must ensure that young persons under the age of 16 are supervised by an adult and behave in a way that does not endanger themselves or other guests.
d) The tenant must ensure that his family members and other occupants of the rented accommodation use the swimming pool and the related structural extensions with due care and show consideration for the other pool users.
e) These swimming rules apply to the following Reka holiday villages: Albonago, Bergün, Blatten-Belalp, Disentis, Hasliberg, Lenk, Montfaucon, Pany, Sörenberg, Urnäsch, Wildhaus and Zinal.
11. The Reka’s liability
The Reka Holidays catalogues have been carefully prepared. However, mis-takes may occur and give rise to complaints. For package arrangements which are covered by the provisions of the law on package tours, liability for damage other than personal injury is limited to twice the rental/travel cost paid for each participant. Should international agreements or laws apply which further limit or exclude the liability of Reka, Reka shall be liable solely within the terms of these agreements and laws. Reka declines all liability for spoiled holidays, holiday time which could not be used, feelings of frustration and so forth. Non-contractual liability is determined by the applicable laws and international agreements. Further limitations of liability and exclusions of liability stated in these rental terms and conditions are reserved. Reka may compensate for the complaint by offering equivalent alternative accommodation. If this is refused, any claim for damages is ruled out.
12. Exclusion of liability
Liability for damages (with the exception of personal injury) is limited to twice the rental price.
13. Events beyond the control of Reka
Reka declines all liability for events caused by factors beyond its control such as blocked access roads, closed highways, higher than usual noise levels, electricity cuts, environmental disasters, sea pollution, political unrest, strikes, opening hours of tourist attractions or government measures of any kind whatsoever. If such events occur the tenant has no right to terminate the contract or claim a reduction of the rental price or compensation.
14. Price and service changes
Reka reserves the right to change published descriptions and prices. When the booking is made, the customer is informed of any price and service changes. Price and service changes may occur exceptionally after the contract has been concluded, e.g. fare changes made by transport companies (including fuel supplements), recently introduced or increased taxes or other charges (e.g. airport tax, landing charges, shipping taxes), currency fluctuations, price rises imposed by the government (e.g. value added tax). The customer will be informed immediately of these price increases.
15. Cancellation and Modifications
A CHF 50.– processing fee is charged for cancellation of a reservation or a booking, for rebooking and any modification of a booking (including a change in the number of persons) or in the case of holiday association offers (Tirreno Resort, Giverola Resort) CHF 200.00. Rebookings and cancellation of transport and extra services are subject to our partners’ cancellation conditions, i.e. our partners’ cancellation costs will be billed over and above our own charges. Instalment payments which have already been made will be imputed against the cancellation costs.
In the event of cancellations and rebookings, Reka bills the following cancellation charges (in addition to the processing fee) on the basis of the rental price:
Reka Holidays Switzerland
- 42 to 10 days prior to beginning of holiday, 50 % of the rental price
- 9 to 1 day before the beginning of the holidays, 80 % of the rental price
- Cancellation on the day the holiday is due to start, no-show at the accommodation location or advanced departure date, 100 % of the rental price. If a replacement tenant is found, only the processing fee is charged.
Reka Holidays Abroad
- 42 to 10 days before the beginning of the holiday, 50 % of the rental price
- 9 to 3 day before the beginning of the holiday, 80 % of the rental price
- 2 days before the beginning of the holiday, until cancellation on the day the holiday is to start, or no-show at the holiday resort or advanced departure, 100 % of the rental price.
Cancellations must be made in writing as soon as possible (e-mail, post or fax). The date on which the cancellation is received by Reka will apply (not the date as postmarked). In the case of Saturdays, Sundays and public holidays, the next working day will be regarded as the date of reception.
16. Cancellation costs, breakdown and medical travel repatriation insurance
To make sure that you are protected against financial loss in case of cancel-lation, breakdowns or repatriation for medical reasons caused by a serious event such as illness, death or accident, you have the possibility of taking out travel insurance when the contract is concluded at a cost of CHF 25.–per person for Reka holidays in Switzerland and CHF 30.– for Reka holidays abroad. For the insured benefits the details given in the Terms and Conditions of AXA Winterthur are alone valid. AXA Winterthur Insurance, General- Guisan-Strasse in 8401 Winterthur, Tel. 0844 802 008 (from abroad +41 844 802 008 or +41 52 218 95 95), email@example.com.When travel insurance is taken out, payment falls due with the rental price (Terms and Conditions of Rental, Section 5). If this payment date is not respected, insurance cover for the booked travel shall lapse. Once your travel insurance has been taken out it cannot be cancelled.
17. Entry Requirements
Swiss citizens need a valid identity card or a valid passport to enter Germany, Austria, the Netherlands, Belgium, Italy, France, Croatia and Spain (the same requirements apply to children, they must have their own passport or their own identity card). Citizens of other countries should enquire about requirements at the embassy or consulate of the country of destination. Each traveller is personally responsible for compliance with the entry requirements.
18. Reka contracts shall be governed exclusively by Swiss law. Claims will be settled by the courts of law in Bern, Switzerland.
